Terms & Conditions of Use

These Terms & Conditions (“Terms”) govern your access to and use of the Ludefix mobile app and related services (the “Service”), offered by Jorge Luis Farías Lampart (“Ludefix”, “we”, “us”). By creating an account, checking the acceptance box, or using the Service, you agree to these Terms and to our Privacy Notice. If you do not agree, do not use the Service.
1. What Ludefix is (and is NOT) — Important medical notice
Ludefix is an educational and entertainment tool to prepare for medical exams (such as Mexico’s ENARM), through questions, cases, and gamified review. Please read carefully:
- The content is study material, NOT medical advice. It does not replace official clinical practice guidelines, textbooks, or the judgment of a healthcare professional.
- Do NOT use Ludefix to make decisions about real patients. It is intended for practice and learning, not for diagnosis, treatment, or clinical care.
- Medicine changes, and content may contain errors, be outdated, or be simplified for teaching. For clinical practice, always rely on current primary sources and your professional judgment.
- We do not guarantee any results. Using Ludefix does not ensure that you will pass any exam or achieve any particular score.
- Using Ludefix does not create a doctor–patient relationship or a formal instructor–student relationship with us.
2. Eligibility and account
- You must be of legal age (18 or older). Ludefix is intended for medical students and professionals; it is not directed to minors.
- You must create an account (Apple, Google, Facebook, or email) and provide accurate information, keeping it up to date.
- You are responsible for your account’s security and all activity under it. Notify us of any suspected unauthorized use.
- Accounts are personal and non-transferable. Do not share your credentials.
3. Acceptable use and content protection
The question bank and curated content are protected. You are strictly prohibited from:
- Copying, extracting, scraping, bulk-downloading, reproducing, distributing, reselling, sublicensing, or making available to third parties the Service’s content, in whole or in part.
- Using bots, scripts, crawlers, or any automated means to access the Service or its content.
- Reverse-engineering or attempting to obtain the source code or the full content bank.
- Interfering with the security or operation of the Service, introducing malware, or accessing areas or data you are not authorized to access.
- Using the Service for unlawful purposes or in violation of these Terms or the law.
Violations may result in immediate account suspension and legal action.
4. Intellectual property
All content, trademarks, logos, design, software, and functionality are the property of Jorge Luis Farías Lampart or its licensors, and are protected by applicable intellectual property laws. We grant you a limited, personal, revocable, non-exclusive, and non-transferable license to use the Service for personal study. Medical facts themselves are not copyrightable; what is protected is the particular expression (wording, selection, organization, and curation) of Ludefix’s content.
5. Subscriptions and payments (Apple in-app purchases)
- Processed by Apple. Subscriptions are purchased and managed through the App Store; Apple processes the payment. We do not receive or store your card details.
- Price. The Premium plan costs [PRICE, e.g. $299 MXN] per month (or the price shown in the App Store for your region, plus applicable taxes).
- Auto-renewal. It renews automatically unless you cancel at least 24 hours before the end of the current period.
- Cancellation. Via your Apple account Settings › Subscriptions. You keep Premium access until the paid period ends; no refund for the current period.
- Refunds. Handled by Apple under its policies. Except as required by law, payments are non-refundable by Ludefix.
- Price changes. You will be notified under Apple’s rules and, where applicable, asked to consent before the change applies to your renewal.
6. Service availability
We work to keep the Service available, but we do not guarantee uninterrupted or error-free availability. It may be unavailable due to maintenance, technical failures, or causes beyond our control, and we may modify or discontinue features.
7. “As is” — no warranties
To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, including as to the accuracy, completeness, or currency of the content. This does not limit warranties that the law recognizes as non-waivable for consumers (see section 12).
8. Limitation of liability
To the maximum extent permitted by law, Jorge Luis Farías Lampart shall not be liable for indirect, incidental, special, punitive, or consequential damages (including data loss, lost profits, or damages from decisions made based on the content) arising from the use of, or inability to use, the Service. Nothing excludes liability that the law does not allow to be limited.
9. Indemnification
You agree to defend and hold harmless Jorge Luis Farías Lampart from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Service, your breach of these Terms, or your infringement of third-party rights.
10. Suspension and termination
We may suspend or terminate your account if you breach these Terms (in particular section 3) or to protect the Service or other users. You may stop using the Service and delete your account at any time (see Support). Certain clauses (intellectual property, limitation of liability, indemnification) survive termination.
11. Changes to these Terms
We may update these Terms. If the change is material, we will notify you by reasonable means (e.g., in the app). Continued use after the effective date constitutes acceptance.
12. Governing law, consumers, and jurisdiction
- These Terms are governed by the laws of the United Mexican States.
- Nothing limits the non-waivable rights that Mexico’s Federal Consumer Protection Law (PROFECO) and other public-order rules grant to consumers.
- For any dispute, the parties submit to the competent courts of Mexico City, Mexico, without prejudice to a consumer’s right to seek their local authority.
- Users outside Mexico: mandatory protections of your local jurisdiction may apply; otherwise, these Terms govern.
